If you register as a Client or Candidate of Source (each a “Member”), additional contractual terms will apply which will be provided to you before we start to carry out services on your behalf.

If you elect to provide personal information through the Member Dashboard (as defined below), we will only process that information in the manner set out in our Privacy Policy and our GDPR statement.

We may make changes to these terms

These Terms are effective as of 25th May 2018. We will amend these Terms from time to time. Please visit this page to check these Terms on a regular basis to ensure you understand the Terms that apply at that time. Your continued use of this website will be taken as your agreement to be bound by the revised Terms.

We may suspend or withdraw our website

You may use this website free or charge. We do not guarantee that our website, or any content on it, will always be available or be uninterrupted. We may suspend or withdraw or restrict the availability of all or any part of our website for business and operational reasons or for regulatory compliance. Wherever possible we will try to give reasonable notice of any temporary suspension by way of a notice on the opening page of the website.

Source has made reasonable efforts to ensure that the information on this website is accurate at the time of inclusion; however, there may be inaccuracies and occasional errors which we will make all reasonable efforts to rectify as soon as we become aware of them. We may also update and change the website from time to time to reflect changes to our service, our Members' needs, our business priorities and/or as may be required by law.

You shall not use this website for any unlawful purpose and in particular agree that you shall not send, use, copy or post anything which is defamatory or obscene or which is abusive, indecent or in breach of the privacy of any person. You agree not to send any unsolicited promotional or advertising material, spam or similar materials or any volume messages that may interfere with the operation of this website or with the enjoyment of this website by Members and/or other visitors. In the interests of maintaining the integrity of our website, we reserve the right to take legal action against anyone found to be using it for any unauthorised purpose.

The Member Dashboard

You may enrol to access Member services (either as a Client or a Candidate) by visiting https://www.wearesource.co.uk.member/register.aspx (the “Member Dashboard”). If you register and are accepted as a Member you will be provided with a unique login and password. You must keep your account details safe and strictly confidential and you must not disclose them to any third party.

Whenever you make use of the Member Dashboard or any other feature of our website to upload content (including without limitation Client briefs, CVs and identity documents), you must comply with the following content standards:

      • You warrant that such material will be up-to-date, accurate and will not breach any applicable laws, regulations, codes of practice, or the rights of any third party, and you will indemnify us for any loss or damage we suffer as a result of your breach of this warranty;
      • You will inform us in advance in writing if any of the content you upload via the Member Dashboard is personal data of a sensitive nature;
      • You must not supply any other person’s data via the Member Dashboard unless we ask you to do so;
      • Save for personal data (which will be processed in accordance with our Privacy Policy and GDPR Statement) the content you upload to our website will be considered non-confidential and non-proprietary. You retain all of your ownership rights in your content, but you are required to grant us a limited licence to use, store and copy that content and to distribute and make it available to third parties for the purposes of fulfilling our agreement with your or as is otherwise required by law;
      • In the event any information you upload becomes out of date, you will use all reasonable endeavours to update such information via the Member Dashboard for such time as you continue to make use of our services.
      • You also acknowledge that while we may provide you with Member Dashboard access we are not obliged to carry out services on your behalf.

We have the right to disable any Member login or password at any time if, in our reasonable opinion, you have failed to comply with any of the provisions of these Terms. If you know or suspect that anyone other than you knows your login or password, you must notify us immediately.

You may cancel your registration to the Member Dashboard at any time amending your preferences using the "deregister" option or by emailing us at hello@wearesource.co.uk.

How you may use material on our website

Source is the owner or the licensee of all intellectual property rights in our website (including any trade marks, branding or logos) and in the material published on it. These works are protected by copyright laws, regulations and treaties around the world. All such rights are reserved.

You may retrieve and display content from the website on a computer, download store such content in electronic form, or print copies for your own use or others within your organisation, provided that those persons have been made aware of these terms. You must not, nor will you permit a third party to, modify printed or digital copies of any materials you have obtained through the website, and you must not use any illustrations, photographs, video or audio sequences or any graphics published on this website.

Member generated content

The Member Dashboard may allow you to access information and materials uploaded by other Members. This information and these materials may not have been verified or approved by us. If you have any concerns about material hosted on the Member Dashboard please contact us.

Our responsibility for loss or damage suffered by you

  • We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.
  • Save as provided above, neither we nor any of our personnel or affiliated companies accept any liability to you whether in contract, tort (including negligence) or otherwise, arising out of it in connection with this website. Source accepts no liability for any direct, special, indirect or consequential damages, or any other damages of whatsoever kind resulting from whatever cause through the use of any information obtained either directly or indirectly from this website, and your sole remedy will be to discontinue using this website.
  • In respect of our delivery of services to you, different limitations and exclusions of liability will apply which will be set out in our terms and conditions for Candidates and Clients. Viruses and Malware

We do not guarantee that our website will be secure or free from bugs or viruses. You are solely responsible for configuring your information technology, computer programmes and platform to access our website. You should use your own up-to-date virus protection software.

You must not misuse our website by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful, or attempt to gain unauthorised access to the Member Dashboard or any information uploaded by a Member. All such actions will be reported to the relevant law enforcement authorities and will be subject to the sanctions provided under the Computer Misuse Act 1990.

Jurisdiction

Please note that these terms, their subject matter and their formation, are governed by English law. You and we both agree that the courts of England and Wales will have exclusive jurisdiction over any dispute arising out of your use of this website.

This website is directed to people with the right to work in the United Kingdom and we do not represent that content available through the website is appropriate or available in other countries.

In the event that any part of the terms shall be determined by any competent authority to be deemed invalid, unlawful or unenforceable to any extent, that part of the terms shall be severed from the remaining terms which shall continue to be valid and enforceable to the fullest extent permitted by law.
